EXPLANATION OF A
PROPOSED ACTIVITY IN a 100-Year Floodplain and
Wetlands


TO: ALL INTERESTED AGENCIES, Groups, and Individuals

This is to give notice that the Mississippi Development Authority (MDA) has conducted an evaluation as required by Executive Orders 11988 and 11990 in accordance with HUD regulations at 24 CFR 55.20 to determine the potential affect that its activity in the floodplain and wetlands will have on the environment. The project is known as Wiggins Regional WWTF and Transmission System (project number S8 as listed in the Mississippi Gulf Region Water and Wastewater Plan). The original S8 project included design and construction of a 1 million-gallon-per-day WWTF, pump stations, and transmission main to meet the immediate needs of this developing area in southern Stone County, Mississippi.

A re-evaluation (24 CFR 58.47) is being conducted of the Environmental Assessment and Finding of No Significant Impact (FONSI) of project S8 due to a proposed addition to the project. The purpose of the proposed addition is to increase customer base, thereby increasing revenue needed for project implementation. The proposed addition includes the construction of wastewater transmission main and two pump stations. The addition begins at the City s East Lagoon located off of Big Four Road and continues in the southwestern direction until it connects to existing S8 transmission main located west of Highway 49 near Hall Street. This addition will serve to divert wastewater from the City s East Lagoon to the newly constructed S8 WWTF. The S8 WWTF is a more "environmentally friendly" method for treating wastewater since it is a zero discharge/drip fieldfacility, whereas the East Lagoon is a facility which discharges to Flint Creek.

The proposed study area for the additional portion of the project is approximately 83 acres, which is based on approximately four miles of transmission main with a study area 150 feet in width and two pump station sites. Per the Federal Emergency Management Agency s (FEMA s) Flood Insurance Rate Map numbers 28131C0134C, 28131C0132C, and 28131C0151C effective June 16, 2011, a portion of the proposed project area will be placed within the 100-year floodplain. Approximately 1.34 acres of the project area will lie in Zone AE. This includes the transmission main area near Four Mile Creek and along East Central Avenue at the Church House Branch crossing. The remaining study area is not in the floodplain.

Additionally, a preliminary wetlands assessment revealed approximately 12.1 acres of freshwater wetland areas, approximately 1,835 linear feet of an intermittent stream channel, and two ephemeral streams within the review area. Potentially jurisdictional wetlands occur on either side of the Highway 49 crossing, along Clubhouse Drive, and near the City s East Lagoon where a pump station will be placed. The preliminary wetlands assessment is not an actual delineation in accordance with the U.S. Army Corps of Engineers 1987 Wetland Manual.

MDA has determined that it has no practicable alternative other than to approve of the placement of the water transmission main and pump stations at the proposed locations. This activity will have no significant impact on the environment for the following reasons:

1. The majority of transmission mains will be placed in existing road right-of-ways. Placement of transmission mainsin the floodplain will not pose a risk to the infrastructure since the transmission mains will be buried underground.

2. Impacts to wetlands and floodplains will only be temporary for the transmission mains since the excavation of the soil for the underground transmission mains will be replaced and backfilled to existing grade.

3. Best Management Practices will be used during construction to prevent sedimentation, erosion and water quality impacts. All necessary federal, state and local permits will be acquired prior to beginning construction, and the appropriate precautionary steps will be taken to prevent any impacts to the floodplain, adjacent waterbodies or wetlands.

WHEREAS, on the 18th day of April, 2008, Randall H. Anderson and Ruth D. Anderson executed a Deed of Trust to Rebecca C. Taylor, for the benefit of Bank of Wiggins, which said Deed of Trust is now of record in the Office of the Chancery Clerk of Stone County, Mississippi,at Wiggins, Mississippi, in Book 299 at Page 473 of the Records of Mortgages and Deeds of Trust on Lands of said County; and
WHEREAS, default was made and now exists in the payment of the indebtedness secured by the said Deed of Trust; and

WHEREAS, said Deed of Trust was subsequently assigned to LNV Corporation by instrument dated December 30, 2008 and recorded in Book 311 at Page 306 of the aforesaid Chancery Clerk's office; and
WHEREAS, LNV Corporation has heretofore substituted J. Gary Massey as Trustee by instrument dated December 21, 2011 and recorded in the aforesaid Chancery Clerk's Office in Book 345 at Page 345; and
